These terms explain how BuildPath works, how information is handled, and what customers and contractors should understand before using the tool.

BuildPath is the tool used to provide this website enquiry process. In these terms, "BuildPath", "we", "us", or "our" means the operator of the BuildPath tool.
The contractor whose website you are using is a separate, independent business. They are not part of BuildPath. BuildPath does not control how the contractor runs their business, prices work, reviews projects, communicates with customers, stores enquiries, or follows up with you.

BuildPath is a smart front door for building enquiries. It helps customers understand a rough project range before they contact a contractor.
BuildPath is not a quote generator. It does not produce fixed prices, binding quotes, formal offers, or final pricing.
Any range shown by BuildPath is:
Final pricing is always confirmed by the contractor after they have reviewed the project. This may include a site visit, scope review, drawings, photos, measurements, access checks, material selections, consent requirements, engineering requirements, and other project details.
Complex, unclear, high-risk, or unusual jobs may be directed to a conversation with the contractor instead of receiving a ballpark range.
When you use BuildPath, the tool may process information you enter, including:
BuildPath uses this information to generate a ballpark range, show a project summary, and pass your enquiry to the relevant contractor if you choose to submit your details.
You do not need to create an account or login to use BuildPath.

BuildPath does not sell your information to third parties.
BuildPath does not use your enquiry information for advertising.
Photos are optional. They can help the contractor understand your project, but you should only upload images that are relevant to the work you are enquiring about.
If you upload photos, you confirm that you have the right to provide them and that they are relevant to the project enquiry.
BuildPath uses third-party service providers to operate the tool. These may include hosting, cloud infrastructure, form handling, email delivery, file storage, payment processing, analytics, and AI processing providers.
Some providers may process or store information outside New Zealand.
Where available, BuildPath uses reputable providers and configures them so information is processed only to operate the BuildPath service.
BuildPath does not intentionally allow customer enquiry information to be used to train public AI models.
BuildPath uses automated processing, including AI-assisted tools, to help generate the ballpark range and explanation shown to you.
A person has not reviewed your specific project at the point the ballpark range is generated.
BuildPath may use AI-assisted processing to support the customer-facing explanation, but key pricing settings, GST treatment, contingency settings, risk rules, and contractor-specific assumptions may be configured separately.
The contractor remains responsible for reviewing the project and confirming any final price.
If you choose to submit an enquiry, your name, phone number, email address, project details, and any uploaded photos are sent to the contractor whose website you used.
Once your enquiry is sent to the contractor, the contractor is responsible for how they use, store, respond to, and follow up on the copy of information they receive. BuildPath remains responsible for any information it continues to hold or process within the BuildPath system.
BuildPath cannot delete, correct, or manage information held separately by the contractor. If your enquiry has already been sent to a contractor and you want them to update or delete their copy, you will need to contact that contractor directly.
If you are unsure who to contact, contact BuildPath and we will point you in the right direction where we can.
BuildPath normally keeps enquiry records for up to 90 days for troubleshooting, contractor handover, service review, and tool improvement, unless we need to keep them longer for legal, security, payment, or service reasons.
After that, information is deleted or anonymised where practical.
Once your enquiry has been sent to a contractor, how long the contractor keeps their copy is up to them. BuildPath does not control the contractor's own record-keeping or privacy practices.
You may ask to access, correct, or delete personal information held by BuildPath.
Who to contact depends on what your request relates to:
BuildPath will respond within a reasonable timeframe.
If you are not satisfied with our response to a privacy request, you may contact the Office of the Privacy Commissioner.
If a privacy breach occurs that is likely to cause serious harm, BuildPath will take reasonable steps to notify affected individuals and the Office of the Privacy Commissioner, in line with New Zealand privacy requirements.

Unless clearly stated otherwise, customer-facing ballpark ranges are shown inclusive of GST.
BuildPath does not guarantee that a contractor will receive any particular number of enquiries, leads, jobs, or customers.
BuildPath also does not guarantee that any individual ballpark range will be accurate for a specific project.
The tool is designed to give customers a clearer starting point and help contractors receive better-quality enquiries. It does not replace contractor judgement, proper scope review, site assessment, or final quoting.
Contractors using BuildPath are responsible for making sure their setup is suitable for their business. This includes checking:

If a contractor purchases BuildPath, payment may be processed through a third-party payment provider. BuildPath does not store full card details. Payment information is handled by the payment provider according to their own terms and privacy practices.
BuildPath setup fees, annual fees, deposits, renewals, and any add-on services will be described at the time of purchase or agreement.
Unless otherwise agreed in writing, BuildPath setup work may not begin until the required upfront payment or deposit has been received.
